These Terms of Use govern access to and use of the Eyami Edit website, creator platform and related services operated by EYAMI EDIT (PTY) LTD (registration number 2026/497128/07), referred to as “Eyami Edit”, “we”, “us” or “our”.

1. Acceptance of these terms

By visiting the website, creating an account, applying as a creator, connecting a social-media account or using any Eyami Edit feature, you agree to these Terms of Use and our Privacy Policy. If you do not agree, you must not use the service.

2. Eligibility

You must be at least 18 years old and legally capable of entering into an agreement to create an Eyami Edit account. If you act for a business or another person, you confirm that you have authority to bind them.

3. What Eyami Edit provides

Eyami Edit is a creator-commerce platform. Approved creators may build profiles, add products, organise products into collections, publish or share collection links, connect supported social-media accounts, create approved automated responses and view available engagement or click information.

During the current pilot, creator access is free and Eyami Edit does not pay creators commissions. Any future paid plan, commission, affiliate arrangement or brand campaign will be governed by additional terms disclosed before it applies.

4. Creator applications and accounts

Creator participation is subject to application and approval. Eyami Edit may accept or decline an application in its reasonable discretion.

5. Creator content and product information

Creators remain responsible for the profiles, photographs, descriptions, product information, links, collections, messages and other material they submit or publish through Eyami Edit (“Creator Content”).

By submitting Creator Content, you confirm that:

You grant Eyami Edit a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display and distribute Creator Content only as reasonably required to operate, promote and improve the service. This licence ends when the content is deleted, except for lawful backups, material already shared externally and records that must be retained by law.

6. Instagram and automated messaging

If you connect Instagram or another supported service, you authorise Eyami Edit to access and process the permitted account information and interactions needed to provide the selected features. You remain responsible for your trigger words, public replies, private messages, links and compliance with the connected platform's rules and applicable direct-marketing laws.

Automated features depend on third-party platforms and may be delayed, interrupted, restricted or discontinued. Eyami Edit does not guarantee that every comment, message or automation will be detected, sent or delivered. You must not use the service for spam, harassment, deception or unauthorised messaging.

7. Third-party products, stores and links

Eyami Edit displays links to products and services sold by independent third-party retailers or brands. Unless expressly stated otherwise, Eyami Edit is not the seller, supplier, manufacturer, fulfilment provider or payment processor for those products. A purchase made after following a link is concluded directly between the customer and the third-party retailer.

The retailer is responsible for product quality, stock, prices, discounts, warranties, delivery, returns, refunds and customer service. Product details can change without notice. Users should verify information and review the retailer's own terms and policies before purchasing.

8. Click and performance information

Any click, engagement or performance information shown by Eyami Edit is provided for guidance. Figures may be affected by browser settings, ad blockers, bots, duplicate activity, platform restrictions and technical limitations. We do not guarantee that statistics are complete, error-free or suitable for any particular commercial decision, and we do not guarantee reach, sales, income or brand opportunities.

The Eyami Edit name, branding, platform design, software, databases and original website material are owned by or licensed to Eyami Edit. Except where these terms expressly allow it, no right or licence is granted to copy, modify, distribute or commercially exploit them.

11. Moderation, suspension and termination

We may review, hide or remove content and may restrict, suspend or close an account where reasonably necessary to protect users, third parties, the platform or our legal obligations, including where these terms or a connected platform's rules are breached. Where appropriate, we will provide notice and a reasonable opportunity to address the issue.

You may stop using Eyami Edit at any time and may request account deletion as explained in the Data Deletion Instructions. Provisions that by their nature should continue after termination will remain in effect.

12. Availability and changes

The service is provided on an “as available” basis. We may maintain, improve, replace or discontinue features. We will make reasonable efforts to communicate material changes affecting approved creators, but we do not promise uninterrupted or error-free availability.

13. Disclaimers and limitation of liability

To the fullest extent permitted by South African law, Eyami Edit gives no warranty that third-party content, product information, external links, analytics or automated features will always be accurate, available or fit for a particular purpose.

To the fullest extent permitted by law, Eyami Edit will not be liable for indirect, incidental, special or consequential loss arising from use of the service, third-party retailers, creator content, external links, lost opportunities, platform interruptions or unauthorised account use. Nothing in these terms excludes or limits liability, remedies or consumer rights that cannot lawfully be excluded or limited, including rights under the Consumer Protection Act where it applies.

14. Privacy

Our Privacy Policy explains how we process personal information. It forms part of these terms.

15. Changes to these terms

We may update these terms when the service or legal requirements change. The updated version will be published with a revised date. Where a change materially affects an approved creator, we will take reasonable steps to provide notice. Continued use after the effective date constitutes acceptance, subject to rights that cannot lawfully be limited.

16. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. Before starting formal proceedings, you and Eyami Edit agree to try in good faith to resolve a dispute by contacting the other party. This does not prevent either party from using any court, regulator or consumer-protection process available by law.
